Case law of the CGC of the Supreme Court: nuances of application of the Code of Civil Procedure

The Supreme Court has released a new edition of its continuously updated overview of the case law of the Commercial Cassation Court within the Supreme Court regarding the application of the provisions of the Commercial Procedure Code of Ukraine – https://court.gov.ua/storage/portal/supreme/ogliady/Oglyad_GPK_27_02_2026.pdf.

The document has been updated with new key findings formed during 2025, which will allow you to minimize procedural errors and expedite case proceedings.

Key highlights of the update:

  • Digitalization of justice: the section on mandatory registration in the “Electronic Court” system has been expanded, along with the procedural consequences of failing to comply with this requirement for legal entities against which bankruptcy proceedings have been initiated;
  • Evidence and expert examination: approaches to addressing the issue of reimbursement for unused expert examinations have been systematized;
  • jurisdiction: the criteria for distinguishing between commercial and civil jurisdiction in disputes regarding the enforcement of obligations (pledge, surety, etc.) have been clarified;
  • settlement of disputes with the participation of a judge: a distinction has been made between a settlement agreement and a procedural deferral of the enforcement of a judgment;
  • Issues related to the enforcement of court decisions: the legal consequences of returning an enforcement document and the status of enforcement measures have been defined.
