Businesses can apply for compensation for property in occupied territories through Diya

A new opportunity for Ukrainian business was launched in Diya — legal entities can submit applications for compensation for losses due to loss of control over property in temporarily occupied territories. It is not just about the value of the property itself: you can also claim lost profits and even a complete loss of business.

The launch of the new service was announced in Diya. Applications are accepted in category C3.2 — “Loss of control over property in temporarily occupied territories.”

It is about entering information into the international Register of damages caused by the aggression of the Russian Federation against Ukraine.

What property can you apply for?

You can apply for property over which a legal entity lost control on February 24, 2022 or later due to the temporary occupation of Ukrainian territories as a result of Russian aggression.

At the same time, the possibility to submit an application remains even in cases where the territory was subsequently vacated and the company has already regained control over its property.

Within this category, property is any tangible asset that has value.

Compensation does not only concern the value of the property

Legal entities can declare several types of economic losses at once.

In particular, it is about:

the value of property over which control was lost;
lost profit due to loss of control over assets;
complete loss of business.

Thus, the mechanism covers not only the immediate value of the assets in the occupied territory, but also the wider consequences that the enterprise may have suffered due to Russian aggression.

Anyone from the business can apply

Applications can be submitted by Ukrainian legal entities regardless of the form of ownership.

In particular, the service is available to state enterprises, business associations, state associations and holding companies.

An application can be submitted on behalf of a legal entity by its head or authorized representative.

If the documents will be submitted by a representative, the head of the legal entity must first grant him the appropriate rights through the “Digital Powers of Attorney” service.

Why was the Register of Damages created?

The register is intended for the collection of statements about damages, losses and damages caused from February 24, 2022 on the territory of Ukraine as a result of internationally illegal actions of the Russian Federation.

Filing a statement allows you to officially record the business’s claims for damages within the framework of the international compensation mechanism.

The service is implemented by the Ministry of Digital Transformation and the Ministry of Justice of Ukraine. The development of the digital service is carried out with the support of the Swiss-Ukrainian EGAP Program, which is implemented by the Eastern Europe Foundation.
