Can an individual entrepreneur spend money from a business account for personal needs: tax clarification

The State Tax Service of Ukraine clarified whether individual entrepreneurs have the right to use funds from their individual entrepreneur account for personal expenses. The tax service emphasized: the current legislation does not prohibit such use if the entrepreneur properly fulfills his tax obligations.
According to the regulations of the National Bank of Ukraine, entrepreneurs are required to open separate accounts for business and for their own needs. At the same time, personal accounts cannot be used for entrepreneurial activities, but the reverse norm is not prohibited by law.
The State Tax Service emphasized that the funds received from economic activities and credited to the individual entrepreneur’s account remain at the entrepreneur’s free disposal. That is, after paying taxes and making all mandatory payments, the entrepreneur has the right to use this money at his own discretion.
At the same time, tax officials remind: the tax obligation is unconditional and primary. Therefore, before spending money on personal needs, the individual entrepreneur must ensure timely payment of taxes and fees. This approach avoids claims from regulatory authorities and does not violate current legislation.
