Military personnel planning to be discharged from service due to the need to constantly care for their disabled parents must provide the command with a special act of verification of family status. The document is issued through the territorial recruitment and social support center (TCK and SP), and not through the ASN.

Why a document from the ASN is not suitable for discharge

According to the lawyer, military personnel often mistakenly apply to administrative service centers or local government bodies to obtain an act of establishing the fact of care.

However, to be discharged from military service due to a relevant family circumstance, another document is required – an act of verification of the military personnel’s family status.

Its registration is carried out with the participation of the TCC and SP. The document must confirm the military’s family circumstances, in particular the presence or absence of other relatives who can provide care.

It is this act that is used when considering a report on discharge from service.

Under what conditions can a serviceman be released to care for his parents

The grounds for the release of servicemen during martial law are determined by Article 26 of the Law of Ukraine “On Military Duty and Military Service”.

As Vladyslav Derii explains, for release due to the need to care for a father or mother, the relevant circumstances must be confirmed.

In particular:

The father or mother of the serviceman, as well as the parents of his wife or husband, have an established disability of group I or II.

The need for constant care is confirmed by an appropriate medical opinion.

The presence of other family members who, by law, can provide care, and the circumstances that prevent them from doing so, are taken into account.

At the same time, the presence of other relatives does not automatically exclude the possibility of release in all cases. A specific legislative basis and proper documentary confirmation of the circumstances are crucial.

What documents must be submitted to the command

To consider the issue of dismissal, the serviceman must prepare a report and documents confirming the right to dismissal.

Depending on the specific circumstances, the following may be required:

A serviceman’s birth certificate to confirm family ties.

A certificate of verification of marital status, drawn up in accordance with the established procedure.

A medical opinion on the need for constant external care.

A document confirming the establishment of a disability of the corresponding group for the father or mother.

Additional documents regarding other family members, if they are necessary to confirm the grounds for dismissal.

Disability can be confirmed by MSEK documents, an extract from the decision of the expert team for assessing the daily functioning of the person, or other documents provided for by law.

What to do if the command refuses to dismiss

If a serviceman believes that his report was unreasonably rejected or left without consideration, he has the right to appeal the relevant actions or inaction.

In particular, you can contact the high command, authorized military management bodies or the administrative court.

Lawyers recommend keeping copies of all submitted documents and recording the fact of registration of reports and appeals.
