Dismissal from the Armed Forces of Ukraine due to disability: lawyers explained the algorithm of actions for servicemen

Military personnel who have been diagnosed with a disability group during their service have the legal right to be discharged from the ranks of the Armed Forces of Ukraine. However, after completing their service, they must complete a number of mandatory legal procedures.

Lawyers reminded of this, commenting on the procedure for registering a discharge and subsequently obtaining a deferral from mobilization.

Who has the right to be discharged

The right to be discharged from military service is determined by the current legislation of Ukraine. One of the grounds is the establishment of a disability group or recognition of a person as unfit or limitedly fit for service due to health conditions.

The key document in this case is the conclusion of a military medical commission confirming the health condition of the serviceman.

How to properly register a discharge

To begin the procedure, a serviceman must submit a report to the commander of the military unit where he serves. Documents confirming the right to be discharged, including medical reports and, if necessary, notarized copies of relevant documents, are attached to the report.

It is on the basis of the resolution of the military medical commission that a decision is made on discharge due to health reasons.

What needs to be done after discharge

After discharge from military service, a citizen is obliged to register for military service at the territorial recruitment and social support center at the place of registration or residence.

Lawyers emphasize that this is a mandatory procedure even for persons with disabilities.

The next step is to apply for a deferment from mobilization on the basis of disability. To do this, you must contact the Center for Administrative Services with documents that identify the person and confirm the established disability group.

At the same time, experts draw attention to the fact that currently the registration of such a deferment through the electronic service “Reserve +” is temporarily unavailable for technical reasons.

Lawyers advise not to delay the registration of documents after discharge in order to avoid possible misunderstandings with military registration and ensure proper legal status.
