Expulsion from university will not always mean loss of deferment: Rada proposes to change rules for students

Students will be able to retain the right to a deferral from mobilization even after being expelled from one educational institution if they continue their studies at another. The Verkhovna Rada has registered draft law No. 15553, which is intended to eliminate the problem when transferring or resuming studies can actually be interpreted as re-obtaining education.

The corresponding draft law has been published on the website of the Verkhovna Rada.

The document proposes to amend Article 10 of the Law of Ukraine “On Education” and clarify when a level of education is considered to be obtained for the purpose of determining the sequence of studies.

When expulsion will not lead to the loss of deferral

The key proposal is that a level of education will be considered to be obtained only after a person has successfully completed the relevant educational program and received a document on education.

This is of fundamental importance for students who have been expelled but have not received a diploma of the relevant level.

If the bill is passed, continuing education after such expulsion will not automatically be considered as re-obtaining the same level of education.

At the same time, an important condition is provided: the student must continue to receive education in the specialty in which he studied before expulsion.

For example, if a student studied at a bachelor’s degree, was expelled before receiving a diploma, and then continued to receive this level of education in the same specialty at another university, this should not violate the sequence of obtaining education.

Therefore, provided that other criteria established by law are met, the student will be able to maintain the right to a deferral from mobilization.

Why the problem arose

The right of students to a deferral during mobilization is related, in particular, to observing the sequence of obtaining levels of education.

In practice, situations arise when a person did not complete his studies at one institution, was expelled, and later decided to continue receiving the same level of education at another university.

The new bill proposes to clearly distinguish between re-acquisition of already received education and continuation of studies that a person has not previously completed.

The very fact of studying at a certain level without receiving the corresponding diploma will not mean that this level of education has already been obtained.

Students are also planning to confirm the deferral each semester

The mechanism for confirming student deferral is also changing.

It is assumed that it will be provided for one semester, and not for the entire academic year at once.

After the semester ends, the educational institution must confirm that the student continues his studies and has not been expelled.

At the same time, it is not necessary to personally contact the CCC just to update the relevant information – the data should be transmitted through electronic registers.

At the same time, bill No. 15553 is currently only registered in the Verkhovna Rada. The rules it proposes for maintaining the continuity of education have not yet entered into force and may change during the consideration of the document by the parliament.
