Families of fallen soldiers want to be guaranteed additional payments: draft law registered in the Rada

The Verkhovna Rada has registered draft law No. 15455, which proposes to guarantee the payment of material assistance to the families of deceased servicemen to resolve social and household issues, if the serviceman himself did not have time to receive it during his lifetime.

The document provides for amendments to the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families”.

What payment is proposed to be introduced

Currently, servicemen, except for conscripts, have the right to receive material assistance once a year to resolve social and household issues. Its amount can be up to one month’s cash allowance.

However, such payment is made only after the serviceman submits a report and the commander issues a corresponding order.

In the event of the death of a serviceman, it is impossible to submit a report, which is why the family actually loses the right to these funds.

What the bill proposes

The authors of the legislative initiative propose to recognize the death of a serviceman as a separate basis for the payment of material assistance to members of his family.

To this end, they propose to supplement Article 18 of the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families” with a new paragraph.

According to the proposed changes, family members of a deceased serviceman will be guaranteed the payment of material assistance to resolve social and household issues in the amount of monthly cash benefits, if the serviceman did not receive it during his lifetime in the manner established by law.

What the authors of the document refer to

The initiators of the bill note that such a norm corresponds to the legal position of the Supreme Court, set out in the resolution of January 20, 2026 in case No. 200/5127/22.

In their opinion, the adoption of the bill will allow to legally establish a social guarantee for the families of fallen defenders and eliminate the legal gap that exists today.
