In Ukraine, you can officially marry from the age of 18. However, the legislation provides for exceptions under which minors can marry as early as 16. To do this, you must obtain court permission, and parental consent is not mandatory.
Is it possible to marry at 16 without parental permission

According to Article 22 of the Family Code of Ukraine, the marriageable age for women and men is 18 years.

At the same time, Article 23 of the Family Code provides that a person who has reached the age of 16 may be granted the right to marry by court decision if this is in their interests.

At the same time, parental consent is not a mandatory condition for concluding such a marriage.

Even if the mother or father opposes the marriage, the court may make a positive decision.

At the same time, the judge has the right to hear the parents’ position and take it into account when considering the case.

Under what circumstances will the court allow marriage before the age of 18

The legislation does not establish an exhaustive list of circumstances that guarantee minors the right to marry.

The court considers each case individually.

In particular, the grounds for granting permission may be:

Pregnancy of a minor girl.

Birth of a joint child.

Actual cohabitation of the couple.

Other circumstances that indicate that the marriage is in the interests of the minor.

At the same time, even pregnancy or the birth of a child does not automatically mean obtaining permission.

The court must determine whether the marriage will be in the interests of the applicant.

How to obtain court permission to marry at the age of 16

A minor who wishes to register a marriage must independently apply to the court at the place of his or her residence.

The application must indicate:

Surname, first name and patronymic of the person with whom the applicant plans to marry.
Circumstances justifying the need to marry before reaching the age of 18.
Information on the absence of legislative obstacles to marriage registration.

For example, the applicant may refer to cohabitation, pregnancy or the birth of a child.

In addition, the court must check whether there are any circumstances that make it impossible to conclude a marriage.

In particular, the Family Code of Ukraine prohibits marriages between close relatives.

Is it possible to get married immediately after the court decision

A positive court decision granting the right to marry does not mean that the couple automatically becomes spouses.

After the court decision enters into legal force, it is necessary to contact the State Civil Status Registration Authority (DRACS).

The future spouses must submit an application for state registration of marriage.

Only after official registration do the rights and obligations of the spouses arise.

What is important for minors to know

Granting the right to marry at 16 years of age is an exception to the general rule about the marriageable age.

The main criterion for the court remains the compliance of such a decision with the interests of the minor, and not the wishes of the parents or the future spouses themselves.

Thus, Ukrainian legislation allows marriage up to 18 years of age, but only with the relevant court decision and subsequent state registration of the marriage.
