Marriage abroad: is it recognized in Ukraine and how to properly prepare documents

A marriage concluded outside Ukraine may be fully valid in the territory of the state, but only if a number of legal requirements are met. The Ministry of Justice explains: the key is that the norms of Ukrainian legislation regarding the grounds for invalidity are observed during the conclusion of the marriage.

Is a marriage concluded abroad recognized

According to the legislation of Ukraine, a marriage concluded abroad according to the rules of another state is recognized as valid in Ukraine. This applies to both marriages between citizens of Ukraine and unions with the participation of foreigners or stateless persons.

At the same time, compliance with the norms of the Family Code of Ukraine is a mandatory condition. In particular, the marriage must not violate the requirements regarding age, voluntariness, monogamy, and the absence of close family ties between spouses.

What norms need to be taken into account

Ukrainian legislation defines marriage as a union between a woman and a man registered with a state body. The main requirements include:

attainment of the age of 18;
voluntary consent of both parties;
absence of another valid marriage;
compliance with restrictions on kinship.

Violation of these norms may be grounds for declaring a marriage invalid even if it was concluded abroad.

How to confirm a marriage in Ukraine

In order for a foreign marriage document to have legal force in Ukraine, it must be properly executed. In particular, this concerns:

legalization of the document – through an apostille or consular legalization;
official translation into Ukrainian with appropriate certification.

In some cases, legalization is not required – if international agreements have been concluded between Ukraine and the relevant state (for example, with the Baltic countries or Poland).

Ukrainian citizens can marry abroad and under Ukrainian law – through diplomatic institutions or consulates. A modern alternative is also available – online marriage registration through the portal “Diya”.
