In Ukraine, certain categories of men aged 25 to 60 with disability groups II and III were allowed to postpone their health reassessment until the end of martial law. The Cabinet of Ministers of Ukraine adopted the relevant decision. However, the innovation does not apply to all persons with disabilities.
Who will be able to postpone the reassessment of disability
The government has made changes to the procedure for assessing a person’s daily functioning. They concern men aged 25 to 60, for whom the Medical and Social Expert Commission (MSEC) had previously established disability group II or III with a specified period of re-examination, but during martial law they did not pass it.
According to the updated rules, the right to postpone the assessment was granted to persons with certain health disorders.
In particular, these are citizens who have:
health disorders that make independent movement and self-service impossible;
lack of hearing, speech or vision in one or both eyes;
lack of an eye, limb, hand, foot or one of the paired organs;
oncological diseases;
intellectual disabilities and mental disorders;
cerebral palsy or other paralytic syndromes;
disability since childhood.
At the same time, the presence of disability group II or III in itself is not a sufficient reason for postponing the re-evaluation.
To apply the special procedure, the person’s age, the circumstances of establishing the disability, the previously determined review period and the compliance of the health status with the approved criteria will be taken into account.
How long will the postponement be valid
In accordance with government changes, citizens who meet the established conditions will be able to undergo a re-evaluation after the termination or cancellation of martial law.
However, this must be done no later than six months after its end.
Until the reassessment, the established disability and the degree of loss of professional capacity will be maintained until the last day of the sixth month after the end of martial law, unless a new decision is made earlier.
Thus, citizens who fall under the new rules should not automatically lose their established status due to the postponement of the reassessment.
Has the mandatory review been canceled?
The government decision does not provide for the complete cancellation of the reassessment of disability.
This concerns exclusively the possibility of postponing the procedure for certain categories of men who have relevant health disorders.
