The delay disappeared in “Reserve+”: why is this happening and how to restore data

Ukrainian conscripts are faced with situations where data on a previously issued deferral from mobilization disappears from the “Reserve+” application. In particular, the problem may arise after a change of residence or transfer to another territorial center for military registration and social support.

As explained by Anastasia Kapustinska, a lawyer at the Eternix bar association, a change in the CCC in itself is not a basis for automatically canceling the deferral.

Why a deferral may disappear

The procedure for conscripting citizens during mobilization is regulated by the Resolution of the Cabinet of Ministers of Ukraine No. 560.

Among the grounds for losing the right to a deferral is not the transfer of a conscript to another CCC. A deferral may lose its validity, in particular, if its validity period expires or the circumstances that were the basis for its granting are lost or change.

Therefore, if the legal grounds for the postponement remain valid, changing the CCC in itself should not deprive the conscript of the corresponding right.

If the information in “Reserve+” has disappeared after being transferred to another CCC, the reason may be a technical problem or the need to update the data.

How to restore a postponement in “Reserve+”

You can register or renew information about the postponement online through the “Reserve+” application, if the corresponding postponement category is available in the system.

The request is processed based on information from state registers. According to the lawyer, the processing of such a request can take up to 48 hours.

Documents for registering a postponement can also be submitted through the Central Service Center.

In this case, it is necessary to prepare documents confirming the right to a postponement and correctly indicate the legal basis in accordance with Article 23 of the Law of Ukraine “On Mobilization Training and Mobilization”.

Errors in documents or incorrect indication of the legal basis may affect the result of the application review.

How long does the application take to review

In the case of submitting documents through the ASN, the decision on the postponement is made by the relevant commission.

As a general rule, the application must be reviewed within seven calendar days. If additional data from state bodies is required to verify the information, the review period may be extended.

Until a decision is made on a properly submitted application, a conscript is not subject to military service during mobilization.

At the same time, it is important to have confirmation of the fact of submitting the application. In “Reserve +” this is a corresponding notification in the application, and after contacting the ASN – a document on the acceptance of the application.

Violation of military registration rules may result in a fine

It is also important for conscripts to promptly comply with the requirements for military registration after changing their place of residence or TCC.

Violation of military registration rules may be grounds for administrative liability.

According to the lawyer, the fine for the relevant violations during the special period can range from 17,000 to 25,500 hryvnias.

Thus, if the information about the deferral suddenly disappeared from “Reserve+”, it is worth checking the relevance of the military registration data and, if necessary, re-issue the deferral through the application or contact the ASN.
