The Supreme Court upheld the acquittal of the judge of the Commercial Court of Kharkiv Region, Tetyana Denisyuk, who was accused of abuse of office in a case related to the Karpatnadrainvest company and the so-called “gas case” of former People’s Deputy Oleksandr Onyshchenko.
On September 22, the Cassation Criminal Court of the Supreme Court considered the prosecutor’s appeal and left the previous court decisions unchanged. Thus, the acquittal against Denisyuk became final.
What was the judge accused of
The case dates back to the events of 2016. Ukrgazvydobuvannya appealed to the court with a demand to recover over UAH 3 million in debt from Karpatnadrainvest. In response, the company filed a counterclaim regarding the transfer of gas and gas condensate to it, which were seized in other criminal proceedings.
Judge Tetyana Denisyuk satisfied the relevant requirements. In addition, she reduced the amount of the penalty and postponed the execution of the debt collection decision for a year.
According to the prosecution, by such actions, the judge could have created conditions for the transfer of property that was under arrest to the company. Anti-corruption authorities also pointed to possible connections between the director of Karpatnadrainvest and members of the Denisyuk family.
Denisyuk was acquitted twice
In May 2021, the Supreme Anti-Corruption Court acquitted the judge for the first time, but in December 2022 the Appeals Chamber overturned this verdict and sent the case for a new trial.
In November 2024, the Supreme Anti-Corruption Court acquitted Denisyuk again. The court concluded that the prosecution had not proven that her actions constituted a criminal offense.
In particular, the court did not establish evidence of extrajudicial contacts between Denisyuk and representatives of the company. Also, the decision in the commercial case was appealed and did not enter into force, and therefore the serious consequences that the prosecution alleged did not actually occur.
In January 2026, the Appeals Chamber of the Supreme Court of Justice left the repeated acquittal unchanged.
The Supreme Court put an end to it
The prosecutor’s office filed a cassation appeal, but the Supreme Court did not satisfy it.
Thus, after many years of consideration of the case, the acquittal against Tetyana Denisyuk finally remained in force.
