They want to provide housing guarantees to former wives of military personnel: a petition has been registered with the Cabinet of Ministers

In Ukraine, it is proposed to change the legislation so that former wives of military personnel who are raising their minor children alone can retain the right to state housing and social guarantees. The corresponding petition has been registered with the Cabinet of Ministers of Ukraine.

The authors of the appeal emphasize that after the dissolution of the marriage, a woman automatically loses the status of a member of the military personnel’s family, and with it the right to a number of housing and social benefits. In their opinion, such a situation negatively affects primarily children who remain with their mother after the divorce.

Why is it proposed to change the legislation

The petition notes that the current norms do not provide adequate protection for the rights of children and former wives of military personnel, especially if the woman is raising a child alone, has a serious illness, disability, or has lost her ability to work.

The authors of the appeal refer to the norms of the Constitution of Ukraine, which guarantee the right to social protection, an adequate standard of living, as well as the protection of the family, motherhood and childhood.

What changes are proposed

The Cabinet of Ministers is asked to develop and submit to the Verkhovna Rada a draft law that would provide for:

a state program to provide housing or pay monetary compensation for former wives of military personnel who are raising young children on their own;
the right of such women and their children to remain or be registered for housing;
verification of the property status of military personnel who receive housing guarantees in order to prevent possible abuse;
priority social, material and housing protection for women with serious illnesses who are raising children on their own;
a guarantee that the housing rights of military personnel’s children will not be terminated due to the dissolution of the marriage between the parents;
improving the mechanism for distributing state housing guarantees with priority given to the interests of young children.
What the authors emphasize

The appeal emphasizes that state support should extend not only to military personnel, but also to their children, who should not lose housing and social guarantees due to the divorce of their parents.

According to the authors, the legislation should ensure a balance between protecting the rights of military personnel and the interests of children and the parent who, after the divorce, is actually raising them independently.

The petition is registered under number №41/010363-26еп. In order for the Cabinet of Ministers to consider the initiative, it must gain the necessary number of votes within the period established by law.
