Businessman Seyar Kurshutov wins his case at the Supreme Court against MP Olena Shuliak

The court of cassation established that the case had been heard without the businessman’s knowledge and in breach of the rules of jurisdiction. The decisions of both instances have been declared unlawful. This is reported by UNIAN.
The Supreme Court has overturned the decision of the Prymorskyi District Court of Odesa and the ruling of the Odesa Court of Appeal in case No. 522/11518/22, brought by member of parliament Olena Shuliak against businessman Seyar Kurshutov and Lasmak LLC.
The claim arose from a statement made public by Seyar Kurshutov in 2022, according to which the husband and brother of Olena Shuliak had left Ukraine taking material valuables with them despite the general mobilisation, Ukrainski Novyny reports.
According to his account, Oleksandr Shuliak and Oleksii Zaremba crossed the border in a Toyota Land Cruiser through the Krakovets checkpoint on 9 March at 23:46 and did not declare the valuables they were carrying: 1.3 million dollars, a collection of icons and three fur coats.
The member of parliament went to court demanding that this information be retracted as untrue. The courts of first and appellate instance initially granted the claim.
However, as the Supreme Court subsequently established, the case was heard without notifying Seyar Kurshutov and without his participation. Because of this, the businessman did not know about the dispute and had no opportunity to object to the claims or to present his own arguments and evidence.
The Supreme Court stressed that this case could not have been heard by the Prymorskyi District Court of Odesa at all, and that a breach of the rules of jurisdiction is an unconditional ground for overturning the earlier court decisions. The decisions of both instances have therefore been overturned.
Consequently, the country’s highest judicial instance has found that decisions taken without the knowledge and participation of Seyar Kurshutov have no legal force.
