Ukraine plans to revise the rules for controlling court records. However, some provisions of the proposed document have raised concerns among judges who see them as potential risks of interference in the administration of justice.
On October 9, the first organizational meeting of the interdepartmental working group was held, which will finalize the draft Procedure for Controlling the Status of Records in Local and Appeal Courts.
The document is intended to determine the mechanisms by which the State Judicial Administration of Ukraine and its territorial departments will exercise appropriate control.
The working group was established by order of the State Judicial Administration of Ukraine dated October 7, 2026 No. 466 at the proposal of the Council of Judges of Ukraine and in accordance with its decision No. 39 dated September 25, 2026.
The Council of Judges warned of the threat to the independence of justice
The Chairman of the Council of Judges of Ukraine, Vitaliy Salikhov, emphasized that a number of provisions of the proposed document raise serious reservations among representatives of the judicial system.
According to him, the Council of Judges received a significant number of comments and proposals from the courts, which indicates the need for significant revision of the draft.
Salikhov emphasized that the main task of the working group is to prepare a document that will have clearly defined goals, will not contain contradictory provisions and will contribute to the proper organization of court proceedings without the risk of interference in the administration of justice.
The State Judicial Administration promises to take into account the comments
Deputy Head of the State Judicial Administration of Ukraine Leonid Sapelnikov confirmed the relevance of developing a new procedure for controlling court proceedings.
He assured that all comments and proposals received in the draft will be analyzed during the preparation of the final version of the document.
Thus, the proposed rules are currently at the stage of revision. The final content of the document will be determined taking into account the positions of representatives of the judicial system.
The key issue remains ensuring a balance between administrative control over the organization of the work of the courts and guarantees of the independence of judges in the administration of justice.
