What is the liability for violations during declaration
In Ukraine, officials subject to financial control requirements are required to submit declarations and indicate in them reliable information about income, property, financial obligations and other assets provided for by law.
Depending on the nature of the violation and the established circumstances, the legislation provides for administrative or criminal liability.
In particular, Article 172-6 of the Code of Ukraine on Administrative Offenses establishes liability for certain violations of financial control requirements.
At the same time, Article 366-2 of the Criminal Code of Ukraine provides for liability for intentional submission of inaccurate information to the declaration, if the discrepancies reach the threshold established by law.
Article 366-3 of the Criminal Code of Ukraine provides for liability for intentional failure to submit a declaration by the subject of declaration.
It is important that the fact that the NACP detects violations does not automatically establish the official’s guilt. The final decision to hold a person accountable is made in accordance with the procedure prescribed by law.
