The Rada proposes to limit the powers of the CCC: what the draft law provides for

The Verkhovna Rada has registered draft law No. 15459, which provides for changes to the procedure for the work of territorial recruitment and social support centers during mobilization events. Among the proposed innovations are mandatory continuous video recording, a ban on hiding faces and using physical force against citizens.

Who will be able to check military registration documents

The draft law proposes to amend Article 22 of the Law of Ukraine “On Mobilization Training and Mobilization”.

In particular, it is planned to more clearly define the circle of persons who have the right to notify citizens and check military registration documents.

Such powers are proposed to be granted only to representatives of the CCC who are officially appointed by the relevant order of the head of the territorial recruitment center.

Video recording should become mandatory

A separate block of the draft law concerns the recording of the actions of representatives of the CCC.

It is proposed to introduce several requirements at once:

photo and video recording of the presentation and verification of military registration documents;
continuous recording during the relevant mobilization events;
equipping CCC vehicles with cameras that will record what is happening inside the vehicle.

It is proposed to store video materials for at least 90 days. This will allow the recordings to be used when verifying citizens’ complaints and conducting official investigations.

They want to ban balaclavas and the use of force

The draft law also directly prohibits CCC representatives from hiding their faces with balaclavas or in any other way during mobilization events.

In addition, it is proposed to prohibit the use of physical force and damage to citizens’ property, including cars.

According to the lawyer, in case of non-compliance with the requirements stipulated by law, further measures to notify, deliver or transport a conscript to the CCC, assembly point or military unit should be stopped.

This rule is proposed to be applied regardless of whether the citizen himself filed a complaint about the actions of the CCC representatives.

Violations are subject to official investigations

In cases of violations, the draft law provides for a mandatory official investigation.

In particular, this concerns situations when CCC representatives did not carry out the prescribed video recording, hid their faces, or exceeded their powers.

At the same time, this is currently a legislative initiative. The proposed rules have not entered into force and may change during the consideration of the draft law in the Verkhovna Rada.

What to do in case of violation of rights

In the event of possible illegal actions during the verification of documents, lawyers recommend that citizens independently record the circumstances on a photo or video.

Such materials can be used as evidence when appealing the actions of officials.

A citizen can also file a complaint with the competent authorities and submit a written statement to the head of the relevant CCC with a detailed description of the circumstances of the incident.

If adopted, draft law No. 15459 should establish additional guarantees for monitoring the actions of CCC representatives during mobilization events and mechanisms for documenting possible violations.
