The Cabinet of Ministers of Ukraine is preparing amendments to the rules for reserving military personnel. Among the proposals is a reduction in quotas for certain enterprises in the defense, energy, and utilities sectors. At the same time, a final decision has not yet been made, so the current reservation rules remain unchanged.
What reservation quotas may change
The government is considering revising the maximum number of military personnel that enterprises have the right to reserve from mobilization.
In previous versions of the draft resolution, the following changes were proposed:
Category of enterprises Current quota specified in the draft Proposed quota
Enterprises of the defense-industrial complex and certain energy companies 100% 85%
Certain enterprises of heat, water supply, and household waste management 75% 60%
Other critically important enterprises 50% 50% – no changes
Important: the above figures are only proposals that were discussed during the preparation of the document. They do not mean that the new restrictions have already come into force.
The final quotas will be known after the adoption and official publication of the relevant resolution of the Cabinet of Ministers.
Who may lose the reservation
If the government approves the reduction of quotas, the changes may primarily affect military employees of enterprises, for whom the maximum percentage of reservation will be reduced.
At the same time, the reduction in the quota in itself does not mean the automatic cancellation of all previously issued deferrals.
The procedure for applying the new limits, in particular to employees already reserved, must be determined by the final version of the government document.
Therefore, it is premature to claim that specific categories of employees will definitely lose the deferral.
What norm was excluded from the draft resolution
According to Dmytro Kysylevsky, the provision that provided for not taking into account employees who already have a deferral from mobilization when calculating the reservation quota was removed from the draft resolution.
This issue was one of the provisions that was reviewed during the preparation of the amendments.
At the same time, the final version of the document has not yet been approved.
A Coordination Center for Reservations may be created in Ukraine
Another proposal is to create a special Coordination Center for the organization of reservations of military personnel under the Cabinet of Ministers.
It is assumed that this body will have advisory functions and will analyze the validity of the criteria by which enterprises receive the right to reserve employees.
In particular, the center will be able to:
analyze the criteria for determining critical enterprises;
evaluate the validity of granting enterprises the appropriate status;
recommend a review of the reservation criteria;
initiate consideration of the issue of the advisability of maintaining the status of a critical enterprise.
In this case, the final decisions will remain with the authorized executive authorities and local administrations.
Why the government wants to change the reservation system
According to the publication, the review of the reservation mechanism is connected with the intention of the authorities to identify cases of unjustified receipt of critical status by enterprises.
Earlier, Prime Minister Serhiy Koretsky explained the need for changes precisely by the need to verify the validity of granting such status.
At the same time, the government declares its intention to avoid negative consequences for enterprises on which the work of the defense complex, energy and other strategic industries depends.
According to Dmytro Kysylevsky, the Ministry of Economy and Environment does not expect a significant revision of the criteria used when determining the possibility of booking employees.
When will the new reservation rules come into force
According to Noviny.LIVE on October 22, the Cabinet of Ministers planned to consider the relevant resolution by the end of the week.
However, until its official adoption and publication, employers should be guided by the current reservation rules.
Only after the publication of the final text will it become clear which quotas will change, how the new restrictions will be applied and whether they will affect previously issued deferrals.
Therefore, the information about the reduction of quotas from 100% to 85% and from 75% to 60% currently refers to the draft amendments, not to the current legal norms.
