Fines for parking in spaces reserved for people with disabilities may increase significantly: draft law submitted to the Rada

The Verkhovna Rada of Ukraine has submitted draft law No. 15403, which provides for increased administrative liability for violation of parking rules in places designated for persons with disabilities. The document also introduces a separate penalty for the improper use of the “Person with a Disability” identification sign.

What changes are proposed

The authors of the draft law note that the current regulations do not provide a sufficient preventive effect and require clarification. In particular, it is proposed to more clearly regulate liability for the use of places for persons with disabilities by vehicles without an appropriate identification sign.

In addition, the draft law should harmonize the provisions of the Code of Ukraine on Administrative Offenses with the legislation, which determines that the right to relevant benefits is associated with the presence of the “Person with a Disability” sign on the car and documents confirming the disability of the driver or passenger.

What fines are proposed to be established

The document proposes:

1,700 UAH (100 non-taxable minimum incomes of citizens) – for stopping, parking or parking in places for persons with disabilities without a “Person with a disability” identification sign;

5,100 UAH (300 non-taxable minimum incomes of citizens) – for illegal use of the “Person with a disability” identification sign.

The draft law also clarifies responsibility for free parking in specially designated places without legal grounds.

What else will change

The initiative provides for clarification of the powers of the National Police and parking inspectors regarding:

consideration of such administrative offenses;
temporary detention of vehicles;
the procedure for appealing resolutions on the imposition of fines.

In addition, it is proposed to abolish the norm that allows members of public organizations of persons with disabilities to draw up protocols on such offenses. In the future, exclusively authorized state authorities will be engaged in recording and considering cases.

When can the new rules come into effect

Currently, draft law No. 15403 has only been registered in the Verkhovna Rada and must undergo parliamentary consideration. If it is adopted, the Cabinet of Ministers of Ukraine must bring its regulatory legal acts into line with the new requirements within six months.
