Ukrainian military personnel who were unable to use their annual basic or additional leave during martial law are entitled to monetary compensation.

Military lawyer Roman Likhachev spoke about the specifics of calculating such payments.

For which vacations is compensation provided

The legislation provides for the possibility of receiving monetary compensation for unused days of several types of vacations.

First of all, this concerns the annual basic leave lasting up to 30 calendar days. If, due to the performance of official duties, the serviceman did not use it in full, the unused days may be compensated.

Compensation is also provided for additional social leave for military personnel who have children or are raising an adult child with a disability.

The duration of such leave is up to 10 calendar days, and in certain cases provided for by law – up to 17 days. Since it is not always possible to use this type of leave during martial law, a serviceman may receive monetary compensation for unused days.

Separately, the legislation provides for additional leave for combatants lasting up to 14 calendar days per year.

Who is entitled to payment

Monetary compensation for unused days of leave is paid to servicemen upon discharge from military service.

The calculation includes all unused days of annual basic and additional leave provided for by law that the serviceman was unable to use during his service.

Thus, the state compensates for unused vacation time with an appropriate monetary payment.

How is the amount of compensation calculated

When determining the amount of compensation, the main components of the serviceman’s financial support are taken into account.

The amount of payment depends on the military’s financial support and the total number of unused days of leave.

The more vacation days remain unused at the time of discharge from service, the greater the amount of compensation will be.

Servicemen are recommended to check information about used and unused vacation days before discharge, and in case of non-accrual of proper compensation, to contact the military unit with the appropriate report and demand a calculation.
