Ukrainians will be able to confirm their experience until 2000 through the court: what the new law changes

The Verkhovna Rada of Ukraine adopted bill No. 13705-d, which significantly changes the approach to confirming insurance experience and interaction of citizens with the Pension Fund.
One of the key innovations was the expansion of opportunities for Ukrainians who have lost documents on employment, in particular for the periods before 2000.
Experience can be proven even without documents
The law provides that in the absence of a work book or other confirmation, citizens can establish the fact of employment relations in court.
At the same time, courts receive broader powers: the use of various evidence is allowed, in particular:
— archival certificates and financial documents;
— bank data on salary payments;
— written contracts;
— witness statements;
— even personal testimony of the applicant under oath in the absence of other evidence.
Especially relevant due to the war
The need for such changes is due to the consequences of a full-scale war: the destruction of enterprises, the loss of archives and the lack of access to documents in temporarily occupied territories.
In many cases, citizens are physically unable to confirm their work experience by traditional means.
Simplified procedure for certain categories
The new rules provide for a simplified judicial procedure for:
— war veterans;
— persons whose documents were destroyed as a result of hostilities;
— employees of enterprises in occupied territories.
The court decision in such cases will be subject to immediate execution and will become the basis for entering data into state registers.
The state assumes more responsibility
The law also changes the general approach: from now on, the Pension Fund is obliged to independently search for information about the length of service in state registers, rather than shifting this responsibility to citizens.
Thus, the new rules should simplify access to pensions and restore justice for those who have lost their documents due to circumstances beyond their control.
