Cruelty to animals in Ukraine: when administrative and criminal liability arises

The law provides for real terms of imprisonment for animal abuse
In Ukraine, animal cruelty is not only morally unacceptable, but also a legally punishable act. Such actions are subject to both administrative and criminal liability, including real terms of imprisonment.
According to the Ministry of Justice of Ukraine, in a number of cases, courts have already imposed maximum penalties for cruel crimes against animals.
What actions are considered cruel treatment
The legislation includes beating, poisoning or mutilating animals, leaving them in dangerous conditions, including in closed cars, improperly keeping them without water, food or shelter.
Cruel training methods, pitting animals against each other and leaving pets to their own devices are also prohibited.
From fines to eight years in prison
Administrative offenses in the field of animal protection are subject to fines from 3,400 to 8,500 hryvnias or administrative arrest.
If cruel treatment has led to the injury or death of an animal, criminal liability under Article 299 of the Criminal Code of Ukraine arises. The sanction provides for imprisonment for a term of 2 to 8 years.
Separately, the law establishes liability for the production and distribution of materials promoting cruelty to animals – up to 8 years in prison.
Actual judicial practice
As noted, Ukrainian courts have already applied maximum terms of punishment. In particular, a verdict was passed in Kyiv, according to which a person was sentenced to 7 years and 6 months in prison for cruel treatment of a homeless animal, which led to its death.
This confirms that the sanctions provided for by law are not a formality, but actually applied judicial practice.
What to do in case of detection of cruelty
The Ministry of Justice recommends that in case of detection of an offense, immediately contact the police, record the facts on photo or video, as well as involve witnesses and animal protection organizations.
It is the proper evidentiary base that is key to the correct qualification of the act and bringing the perpetrators to justice.
Strengthening control and responsibility of animal owners
Special attention is paid to the rules for keeping pets. Fines are also provided for violation of the established norms, in particular for the lack of registration of pets.
At the same time, animal registration systems are being introduced in the cities of Ukraine, which allow to increase the level of their protection and simplify the return of lost animals to their owners.
Thus, Ukrainian legislation forms a more stringent system of responsibility aimed at protecting animals and preventing cruelty to them.
