Real estate under guard, land under surveillance: how will the seized property transferred to ARMA be stored?

The Cabinet of Ministers of Ukraine has approved the procedure for storing assets transferred to the management of ARMA, effectively forming a unified system for handling seized property. The new rules are aimed at preserving the economic value of assets and preventing their deterioration, loss or illegal alienation.
This concerns a wide range of property – both movable and immovable: residential and commercial properties, transport, as well as land plots, which are transferred to the agency by court decision. At the same time, the procedure does not apply to cash – their management is carried out separately in accordance with the legislation.
How storage is organized
According to the government decision, ARMA will attract custodians and specialized organizations through public procurement procedures. They will be responsible for the physical preservation of assets, their technical condition and protection.
Immovable property – buildings, structures and other objects – will be subject to mandatory protection. This will minimize the risks of damage, illegal entry or other illegal actions.
Land plots are under regular control
The procedure for handling land plots is separately regulated. If they are not part of other assets, they are not transferred for storage, but are controlled through regular inspections.
Such inspections will be carried out by officials of the territorial departments of ARMA at least once a month. In case of violations or risks, law enforcement agencies may be involved in the inspections. At the same time, inspections are not carried out in areas of active hostilities or temporarily occupied territories.
Obligations and restrictions for custodians
Custodians and involved organizations are obliged to:
ensure the preservation of the asset without damage or loss;
guarantee proper security;
maintain the technical condition of the property;
if necessary, carry out insurance.
At the same time, they are prohibited from transferring assets to third parties or storing them in inappropriate conditions.
Special attention is paid to security issues: custodians cannot be citizens or companies associated with aggressor states or sanctioned persons, as well as entities with relevant beneficiaries.
When the contract is terminated
The custody agreement is terminated in the event of the transfer of the asset to the manager, its sale, or the cancellation of the seizure. The basis is also a court decision to collect property to the state income or the cancellation of the transfer of the asset to ARMA.
Thus, the government has introduced a comprehensive mechanism for controlling seized assets, which should ensure their safety and transparent management even in conditions of increased risks.
