The Rada proposes to change the powers of the prosecutor’s office regarding representation in court

The Verkhovna Rada has registered a government bill No. 15253, which provides for amendments to the Law of Ukraine “On the Prosecutor’s Office” in terms of representing interests in court. The relevant information has been published on the parliament’s website.
The document proposes to bring the provisions of the law into line with the Constitution of Ukraine and clarify the powers of prosecutors in court proceedings.
Prosecutors will represent only the interests of the state
The bill provides for the rewording of Article 23 of the Law “On the Prosecutor’s Office”. In particular, it is proposed to stipulate that the prosecutor represents exclusively the interests of the state in court.
At the same time, it is planned to exclude from the legislation the norms that allow prosecutors to represent the interests of citizens.
Cases of representation in court are being clarified
The document also specifies the list of cases in which the prosecutor may represent the interests of the state in court. In particular, this concerns cases in the field of objects of civil law that have been withdrawn or restricted from civil circulation.
In addition, the draft law proposes to harmonize the prosecutor’s procedural powers with the current procedural legislation and the basic principles of judicial proceedings.
The draft law should bring the norms into line with the Constitution
The initiators of the document note that the changes are aimed at eliminating legal conflicts and bringing the legislation on the prosecutor’s office into line with constitutional norms.
The draft law has currently been submitted for consideration by the relevant committee of the Verkhovna Rada.
