The High Council of Justice reviewed the disciplinary decision regarding Oleksandr Prodan

The High Council of Justice partially overturned the decision of the Qualification and Disciplinary Commission of Prosecutors dated December 3, 2025 regarding the prosecutor of the Tyachiv District Prosecutor’s Office of the Zakarpattia Oblast Oleksandr Prodan.

12 members of the High Council of Justice voted for the relevant decision, 7 against.

The essence of the dispute: untimely declaration of integrity

The basis for the disciplinary proceedings was the untimely submission of the declaration of integrity by the prosecutor. The document was submitted on May 1, 2025 instead of the statutory deadline of March 31.

In addition, the submitted declaration indicated information about the absence of actions that could discredit the prosecutor’s title, which became the subject of verification by the disciplinary body.

The QDCP also recognized the reasons for the delay as unwarranted, in particular, official employment and participation in competitive procedures.

Decision of the QDCP: reprimand and disciplinary qualification

On December 3, 2025, the Qualification and Disciplinary Commission of Prosecutors brought Oleksandr Prodan to disciplinary responsibility and reprimanded him.

The Commission qualified the actions of the prosecutor as those that discredit the title of prosecutor and may raise doubts about his objectivity, impartiality and integrity.

Position of the High Council of Justice

The HCC concluded that the untimely submission of the declaration of integrity in itself is not a sufficient basis for qualification as actions that discredit the title of prosecutor.

The judicial body noted that such a violation does not have a sufficient level of negative moral and ethical content to apply the strictest qualification.

At the same time, the HCC left the other conclusions of the disciplinary body in this case unchanged.

Thus, the High Council of Justice partially overturned the decision of the CDCP, clarifying the limits of application of disciplinary qualification regarding violations related to prosecutors’ declarations of integrity.
